Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to all customers and users of the services provided by Cobay Technology Private Limited and is incorporated by reference into our Terms of Service. By using the Services, you agree to comply with this AUP. Violations may result in suspension or termination of your account without refund and may be reported to law enforcement.

01 Prohibited Content and Activities

You must not use the Services to upload, store, transmit, or process any content, or engage in any activity, that:

1.1 Violates Law

  • Is illegal under applicable law (including Indian law and the laws of jurisdictions in which you operate)
  • Promotes or facilitates illegal activity, including fraud, money laundering, or sale of prohibited goods or services
  • Infringes any intellectual property, privacy, publicity, or other right of any third party
  • Violates the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, or other applicable data protection laws

1.2 Harms Others

  • Is defamatory, obscene, hateful, harassing, threatening, or invasive of another's privacy
  • Exploits minors or contains child sexual abuse material
  • Promotes self-harm, suicide, or violence
  • Discriminates against any individual or group based on race, religion, gender, sexual orientation, disability, or other protected characteristic

1.3 Is Deceptive or Fraudulent

  • Misrepresents your identity, affiliation, or origin
  • Sends unsolicited marketing in violation of applicable anti-spam laws (including TRAI regulations)
  • Engages in phishing, spoofing, or other deceptive practices
  • Manipulates pricing, reviews, ratings, or marketplace metrics in violation of platform rules

02 System Abuse

You must not:

  • Attempt to gain unauthorized access to the Services, other accounts, or any related systems or networks
  • Probe, scan, or test the vulnerability of the Services, except through our authorized security disclosure process
  • Bypass, disable, or interfere with security or authentication mechanisms
  • Introduce viruses, malware, worms, trojans, or other harmful code
  • Use the Services to launch denial-of-service attacks or send unsolicited bulk messages
  • Reverse engineer, decompile, or disassemble any part of the Services (except to the extent permitted by mandatory law)
  • Use bots, scrapers, or automated tools to access the Services in ways not authorized by us
  • Resell, sublicense, or commercially redistribute access to the Services without our written consent

03 Excessive Use

You must not place an unreasonable burden on the Services, including:

  • Excessive API calls beyond documented rate limits
  • Storing or transmitting unusually large volumes of data not consistent with normal e-commerce operations
  • Activities that interfere with other customers' use of the Services

We may impose technical limits or contact you if your usage is materially out of line with normal patterns.


04 Compliance with Third-Party Platforms

When you use integrations (such as marketplaces or couriers), you must comply with their terms of service and acceptable use rules. We may suspend integrations if your use violates a third-party platform's rules.


05 Reporting Violations

If you believe someone is violating this AUP, please report it to abuse@cobay.com with as much detail as possible.


06 Enforcement

We may, at our sole discretion and without prior notice:

  • Investigate suspected violations
  • Remove or disable access to violating content
  • Suspend or terminate accounts
  • Cooperate with law enforcement and regulatory authorities
  • Pursue legal remedies including damages and injunctive relief

We may modify this AUP at any time. Material changes will be communicated through the Services or by email.
