Overview

By signing up for Cobay's services, you automatically agree to this Anti-Spam Policy. This agreement applies to all users registered after 27th May, 2026.

Cobay Technology Private Limited commits to combating spam across all communication types sent through its platform—including order updates, tracking notifications, NDR messages, marketing campaigns, and emails, SMS, WhatsApp, or push notifications. This policy integrates into the Terms of Service and Acceptable Use Policy. Violations may result in account suspension or termination without refund.

What is spam?

Spam encompasses unsolicited, unauthorized, or unwanted electronic communications sent in bulk or violating applicable laws or platform rules:

  • Marketing emails or SMS to non-consenting recipients
  • Messages sent to harvested, purchased, or scraped contact lists
  • Messages with deceptive subject lines, sender names, or content
  • Messages failing to identify senders or provide valid opt-out mechanisms
  • Communications violating TRAI regulations, DPDP Act 2023, IT Act 2000, or jurisdictional anti-spam laws (CAN-SPAM, GDPR/ePrivacy, CASL, etc.)

Customer obligations

2.1 Consent

  • Send communications only to recipients with valid consent or existing customer relationships permitting communication
  • Maintain and provide consent records upon request
  • For DPDP Act compliance, ensure consent is free, specific, informed, unconditional, and unambiguous

2.2 Honest Content

  • Use accurate sender identification (name, brand, return address)
  • Avoid misleading subject lines or "from" headers
  • Clearly identify promotional content as advertising where required

2.3 Opt-Out

  • Include clear, functional unsubscribe or opt-out options in every marketing communication
  • Honor opt-out requests promptly—within 10 business days maximum, ideally immediately
  • Do not require login, payment, or additional information to opt out

2.4 List Hygiene

  • Do not send to purchased, rented, scraped, or unauthorized lists
  • Promptly remove invalid, bounced, or unsubscribed addresses

2.5 Transactional vs Marketing

  • Use transactional channels exclusively for legitimate transactional purposes
  • Do not insert marketing offers into transactional messages violating applicable law

2.6 Compliance with Platform Rules

  • Comply with third-party messaging provider rules used through the Services (WhatsApp Business Platform policies, SMS aggregator rules, email provider terms)

Cobay's role and rights

Cobay provides infrastructure; you bear responsibility for content, consent, and message lawfulness.

Cobay may, at its sole discretion:

  • Monitor sending patterns, bounce rates, complaint rates, and abuse indicators
  • Throttle, block, or refuse sending communications reasonably believed to violate this policy
  • Require consent evidence for any sending activity
  • Suspend or terminate accounts violating this policy, plus other Terms remedies
  • Report serious violations to law enforcement and upstream providers (email, SMS, WhatsApp)

Reporting spam

Report spam sent through the Services to abuse@cobay.com including:

  • A message copy (including full headers for email)
  • Date and time received
  • Your contact details (optional, but helpful)

Cobay investigates and takes appropriate action.

Indemnification

You agree to indemnify and hold harmless Cobay against claims, fines, penalties, or damages (including legal fees) arising from communications you send violating this policy or applicable law.

Changes to this policy

Cobay may update this policy periodically. Material changes are communicated through Services or email. Continued Service use after changes indicates acceptance of updated policy.
